A majority of the Supreme Court of Canada ruled that certain prohibitions on fishing in two federal regulations were invalid as being inconsistent with treaty rights under the Mi’kmaq Treaties of 1760-61, while a dissenting opinion determined that the Treaties conferred no general trade right.
