The Queen v. Big M Drug Mart Ltd., 1985
From: The Court and the Charter
$0.90
The Supreme Court of Canada held that the true purpose of the Lord’s Day Act was to compel the observance of the Christian Sabbath and as such infringed on the freedom of conscience and religion guaranteed in the Canadian Charter of Rights and Freedoms. A majority of the court relied on a purposive analysis while one member of the court analyzed the effect rather than the purpose of the enactment.
