The Supreme Court of Canada ruled that after federal legislation recognized same-sex conjugal relationships, a same-sex spouse of a deceased Canada Pension Plan contributor was entitled to a survivor’s benefit, but rejected an argument that the right to claim such benefits was retroactive to the coming into force of the equality provisions of the Canadian Charter of Rights and Freedoms in April 1985.
