A majority of the Supreme Court held that a provincial law prohibiting Quebeckers from taking out private insurance for services available under the public health care plan infringed the Quebec Charter of Human Rights and Freedoms, and three of seven judges also held that the legislation infringed the Canadian Charter of Rights and Freedoms.
