A divided Supreme Court of Canada ruled that most provisions of the federal Assisted Human Reproduction Act were an invalid intrusion on provincial jurisdiction by attempting to regulate hospitals and medical research, but considered provisions dealing with donor consent, age of consent and surrogacy expenses to be valid criminal law.
